The Personal Data Protection Commission ("PDPC") will be charging a tuition agency and its director for breaches of the Personal Data Protection Act 2012 ("PDPA"). The agency had been sending unsolicited telemarketing messages to Singapore phone numbers already registered with the Do Not Call ("DNC") Registry.
Notably, both the tuition agency and the director will be charged in Court with up to 37 counts of contravening section 43(1) of the PDPA. Section 43(1) prohibits persons from sending telemarketing messages to Singapore phone numbers unless they have first checked the DNC Registry and received confirmation that the Singapore phone number is not in the relevant register.
If they are found guilty of the offence, the agency and director are liable for a fine of up to S$10,000 per message sent.
If you intend to conduct any kind of telemarketing, ensure that you check the DNC Register first, or obtain clear and unambiguous consent to send telemarketing messages.
