I have endeavored to condense the most salient and useful points in this post.

It has now been 8 months since the data protection provisions have been in force and we are beginning to see an awareness of data protection and privacy rights emerge in the general public. Accordingly, we're also beginning to see news reports raising the question of whether there have been breaches of the PDPA.

Does not show up on published site. 19/1/2015 13 January 2015Dharma SadasivanAhead of the UK's general elections, David Cameron has argued that the UK government should be allowed to access any and all forms of communication. It is premised on his assertion that until now, governments have always taken the position that there should be no means of communication that the government is unable to gain access to, which is why certain intrusive activities (think wiretapping) can be carried out with a warrant. He implies that his position is just a simple extension of the current practice.

Does not show up on published site. 13/1/2015 12 January 2015Dharma SadasivanThe Singapore Personal Data Protection Commission ("PDPC") recently released Advisory Guidelines for the Healthcare Sector (the "Guidelines"), on the application of the Personal Data Protection Act 2012 ("PDPA") to the healthcare sector. What's notable about these Guidelines is that they were developed together with Singapore's Ministry of Health ("MOH").

Does not show up on published site. 12/1/2015 16 July 2014Dharma SadasivanThe Personal Data Protection Regulations 2014 ("PDP Regulations") elaborates on the various ways in which a transfer of personal data out of Singapore may be effected in compliance with the transfer obligation of the Personal Data Protection Act 2012 ("PDPA"). One of the ways - the individual's consent - is (in my view) circular, and ultimately ineffective in practice.
